Introduction

These Terms of Service ("Terms") govern your access to and use of NovelWorld.AI ("we," "us," or "our"), including our website, applications, and AI-powered creative writing tools (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not access or use the Service.

1. Eligibility

To use NovelWorld.AI, you must:

  • Be at least 13 years of age (or the minimum age of digital consent in your jurisdiction)
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

NovelWorld.AI is a creative writing platform that provides tools for:

  • Story planning and outlining
  • Character development and management
  • World-building and lore organization
  • AI-assisted prose generation and editing
  • Project organization and manuscript management

We may add, modify, or discontinue features at our discretion with reasonable notice to users.

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account with accurate and complete information. You agree to update your information as necessary to keep it current.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately at support@novelworld.ai if you suspect unauthorized access

We are not liable for any loss or damage arising from your failure to protect your account credentials.

3.3 Account Termination

You may delete your account at any time through your account settings. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice depending on the severity of the violation.

4. Content Ownership and Intellectual Property

4.1 Your Content

You retain full ownership of all content you create using NovelWorld.AI, including stories, characters, outlines, world-building materials, and any other creative work ("User Content"). We claim no intellectual property rights over your User Content.

4.2 License to Operate the Service

By uploading or creating User Content on the Service, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing and improving the Service. This license terminates when you delete your content or account.

4.3 AI-Generated Content

Content generated by our AI features based on your prompts and inputs is considered part of your creative work. You own the rights to use, modify, publish, and commercialize AI-generated content created through your use of the Service, subject to Section 5 below.

4.4 Our Intellectual Property

The Service, including its design, features, code, trademarks, and underlying technology, is owned by NovelWorld.AI and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as intended.

5. AI Features and Responsible Use

5.1 Nature of AI-Generated Content

AI-generated content is provided as a creative tool to assist your writing process. AI outputs may contain errors, inconsistencies, or unintended content. You are solely responsible for reviewing, editing, and verifying all AI-generated content before use or publication.

5.2 No Guarantees

We do not guarantee that AI-generated content will be original, accurate, suitable for any particular purpose, or free from similarities to existing works. You assume all risk associated with your use of AI-generated content.

5.3 Your Responsibility

You are responsible for ensuring that your use of AI-generated content complies with applicable laws and does not infringe third-party rights.

6. Acceptable Use Policy

6.1 Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or to promote illegal activities
  • Generate content that exploits, harms, or endangers minors
  • Create content intended to harass, threaten, defame, or incite violence against any person or group
  • Generate content that infringes the intellectual property rights of others
  • Attempt to circumvent usage limits, access controls, or security measures
  • Use automated systems, bots, or scripts to access the Service without prior written permission
  • Share, sell, or transfer your account credentials to others
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Misrepresent your identity or affiliation with any person or entity

6.2 Content Standards

While we support creative freedom, content created on the Service must not:

  • Depict sexual content involving minors
  • Provide instructions for creating weapons, explosives, or dangerous substances
  • Constitute or promote fraud, phishing, or other deceptive practices

6.3 Enforcement

We reserve the right to remove content and suspend or terminate accounts that violate this Acceptable Use Policy, at our sole discretion.

7. Subscriptions and Payments

7.1 Subscription Plans

Certain features require a paid subscription. Available plans and pricing are described on our website and may change with reasonable notice.

7.2 Billing

By subscribing, you agree to:

  • Pay all applicable fees at the rates in effect when charges are incurred
  • Provide accurate and complete billing information
  • Authorize us to charge your designated payment method

7.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period.

8. Refunds and Cancellations

When you cancel your subscription:

  • You retain access to paid features until the end of your current billing period
  • Your account reverts to the free tier (if available) or becomes inactive
  • Your content remains accessible unless you choose to delete your account

9. Service Availability and Modifications

9.1 Availability

We strive to maintain high availability but do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

9.2 Modifications

We may modify, update, or discontinue features of the Service at any time. For material changes that negatively affect your use, we will provide reasonable advance notice where practicable.

9.3 Data Portability

You may export your content at any time using the export features available in your account.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, ORIGINAL, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOVELWORLD.AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
  • ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE
  • ANY DAMAGES ARISING FROM AI-GENERATED CONTENT

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY.

12. Indemnification

You agree to indemnify, defend, and hold harmless NovelWorld.AI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights

13. Dispute Resolution

13.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at legal@novelworld.ai and attempt to resolve the dispute informally for at least 30 days.

13.2 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

13.3 Jurisdiction

Any disputes not resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes:

  • We will update the "Last Updated" date at the top of these Terms
  • We will notify you via email or through a prominent notice on the Service
  • Where required by law, we will obtain your consent

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NovelWorld.AI regarding the Service.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
